The operator of bootypics.com is not the primary "producer" of any images or video recordings of explicit sexual or simulated sexual conduct that may be featured there. In the case of content furnished by third-party users of the website, whether explicitly sexual in nature or otherwise, the operators and owners of bootypics.com confine their activities to the transmission, storage, retrieval, hosting and/or formatting of that content. All portions of the website that display such user contributed content are under the control of the relevant users. Owing to this, the operators and owners of the website are released from compliance with Section 2257 records keeping and labeling obligations as stipulated in 28 C.F.R. §75.1(c)(4). Any content on the website that, at the operator’s sole discretion, is held to be illegal, unlawful, obscene, defamatory, or which in any way contravenes the website's terms of use or other policies may be taken down.
